TERMS AND CONDITOINS
Terms and Conditions for Agents based in Spain

By accepting the Terms and Conditions, you are agreeing to the following terms:

Duration ::
1. Agent account shall commence with effect from today and shall continue until closed by either party.

Agreement ::
2. Wincham and the Agent agree to work together for their mutual benefit. Either party will introduce clients wishing to purchase or rent properties in Europe to each other. Either party will make available to their mutual clients properties they are offering for sale or rental. Should a sale or rental result from any introduction from either party it is agreed that any commissions earned by either party, in respect of the sale or rental, shall be split 50/50. Each party shall be responsible for their own costs incurred and these shall not be deducted from any commissions due.

Payment ::
3. All commissions payable shall be paid within 14 days of the signing of the Title Deeds or Tenancy Agreement. The payments shall be made directly to the nominated bank account of the recipient together with e-mail confirmation that the payment has been made.

Supply of Information ::
4. Either party, at the request of the other, shall provide information in respect of properties they are offering for sale or rent that meet the criteria specified at the time of request. The information, including photographs, full specification and asking price and total commissions due at point of sale or rental shall be sent by e-mail to the requester.

Client Services ::
5. As required, either party shall assist clients in so far as within their capability in the following matters:
a. queries regarding living in Europe of a general nature.
b. meetings if requested.
c. arrange for inspection visits of the Properties.
d. preparation of private contracts relating to use and other arrangements relating to any property purchased.
e. introduction to bankers and opening of bank accounts.
f. introduction to funders and lenders if required.

Other Provisions ::
6. Neither Party shall be authorised to bind the other to any agreement or commitment in relation to any transaction.

Governing Law ::
7. This agreement shall be governed by the jurisdiction of the areas of Alicante and Valencia.

Notices ::
8. Any notices to be given under this Agreement must be in writing and served by first class mail or facsimile transmission. E-mail service is not sufficient.
